Controversy Erupts Over Kerala Congress Social Media Post Targeting Chief Justice

A Kerala Congress social media post sparks demands for contempt proceedings against the Chief Justice of India, raising concerns about judicial integrity.

New Delhi, October 13 (Daily Kiran) : A fresh controversy has emerged surrounding a social media post by the Kerala unit of the Congress party. A lawyer has called on the Supreme Court to take suo motu cognizance of the matter and initiate contempt proceedings against Chief Justice of India, D.Y. Chandrachud.

The post, which has since been deleted, was shared on the platform X and read: “Dear Chandrachud, if maintaining law and order is beyond your capability, resign now. We will find someone who can handle it.”

Lawyer Vineet Jindal has lodged a complaint with the Chief Justice, urging an investigation into the post and protests that occurred within the Supreme Court premises. He expressed concerns about the security of the court and its operations.

In his complaint, Jindal emphasized the need for a thorough investigation to determine whether the post constitutes valid political criticism or falls under the purview of the Contempt of Courts Act, 1971, Section 2(c). He referenced Article 129 of the Constitution, which empowers the Supreme Court to punish for contempt.

Additionally, Jindal has requested an inquiry into the protests led by opposition leader Rahul Gandhi and other leaders from the India Bloc during a recent petition filing. He questioned whether there was unauthorized access to restricted areas, violations of security protocols, or disruptions to the court’s functioning.

Jindal insisted that any conclusions should be preceded by securing and reviewing relevant CCTV footage, access-control logs, security records, and other evidence.

Previously, both the Supreme Court Bar Association and the Supreme Court Advocate-on-Record Association condemned statements calling for the Chief Justice’s resignation, warning that such remarks undermine the dignity of the judiciary and interfere with the administration of justice.

It is noteworthy that the India Bloc had marched on Monday against electoral irregularities and the SIR process. Following this, a delegation of opposition leaders filed a joint petition in the Supreme Court challenging the electoral list amendment process.

Lawyers have also reached out to the Supreme Court regarding an incident on Monday when leaders, including Rahul Gandhi, went to the registry to file a petition challenging the opposition. When senior lawyer Gaurav Bhatia mentioned the matter on Tuesday, the Chief Justice inquired if it was on the mentioning list. Upon learning it was not, he instructed, “Mention it tomorrow.”
