Brazils Supreme Court Temporarily Halts Law Reducing Sentences for January 8 Attackers

São Paulo, May 10: Brazil’s Supreme Federal Court has temporarily suspended a new law that aimed to reduce sentences for those convicted in connection with the January 8, 2023, attacks on government buildings. This law also involves former President Jair Bolsonaro.

According to a report from the Xinhua news agency, Justice Alexandre de Moraes stated on Saturday that it is inappropriate to implement the law until the court determines its constitutionality. He emphasized that this step is essential to maintain legal clarity. Justice de Moraes has been tasked with reviewing the law’s constitutionality.

The law was recently passed by Parliament, overturning a veto by President Luiz Inácio Lula da Silva. It includes provisions for reducing sentences for crimes related to attempts at a coup and attacks on the democratic system.

On January 8, 2023, thousands of protesters stormed the presidential palace, Parliament, and the Supreme Court in Brasília. This incident occurred following the 2022 election results, which saw Luiz Inácio Lula da Silva elected as president. The attack is considered a significant assault on democratic institutions, leading to numerous arrests.

Last September, the Supreme Court sentenced former President Jair Bolsonaro to 27 years and 3 months in prison for allegedly leading an attempt to overthrow the government after losing the 2022 election.

Earlier in March, the First Chamber of Brazil’s Supreme Federal Court rejected Bolsonaro’s appeal for house arrest, stating that he was receiving adequate health care in prison and did not qualify for special release. The justices highlighted that Bolsonaro’s frequent meetings with associates indicate that his physical and mental health are stable.

On April 30, Brazil’s Congress overturned President Lula da Silva’s veto that had blocked a sentencing bill. This bill could have reduced sentences for those found guilty of the January 8 attacks on federal government buildings.

This legislative move, known as the Dosimetry Bill, reduces sentences for crimes such as attempts at a coup and violent efforts to dismantle the democratic system. It allows for a reduction of one-third to two-thirds of the sentences for those found guilty as part of the mob, provided they are not organizers or financial backers. Lawmakers overturned the veto with a vote of 318-144 in the lower house and 49-24 in the Senate.

The law could potentially affect nearly 280 individuals, including former President Jair Bolsonaro.
