Bihar Independent MLCs’ Membership Under Scrutiny Following BJP Switch

A delegation demands the disqualification of two independent MLCs in Bihar after their sudden switch to BJP, citing constitutional violations.

Patna, November 2 (Daily Kiran) : In Bihar, the political landscape is shifting as the membership of independent Members of the Legislative Council (MLCs) Banshidhar Brajwasi and Rahul Raj is being challenged. Following their recent decision to join the Bharatiya Janata Party (BJP), a delegation from the Jan Suraj party met with the Executive Chairman of the Bihar Legislative Council, Professor Dr. Ramvachan Rai, on Monday.

Led by former MLA Kishore Kumar Munna, the delegation submitted a petition demanding the disqualification of both MLCs. They argued that Brajwasi, elected from the Tirhut Graduate constituency, and Raj, from the Saran Teacher constituency, joined the BJP within 72 hours of their election victory. This action, they claim, violates the provisions of the Tenth Schedule of the Constitution.

After the meeting, Munna stated that independent members who join a political party post-election risk losing their membership. He urged the Chairman to issue notices to the involved parties and take appropriate actions based on the constitutional framework. The delegation has also involved the Election Commission of India, the Chief Electoral Officer of Bihar, the Chief Secretary, and the relevant Commissioner as parties to this matter.

Munna noted that both MLCs have publicly acknowledged their membership in the BJP. The delegation provided evidence, including news articles and media statements, to support their claims via a pen drive to the Chairman. In response, the Chairman assured the delegation that legal experts would be consulted to ensure proper action is taken.

Former MLC Rambali Singh Chandravanshi expressed concerns about delays in justice but emphasized the seriousness of the case as acknowledged by the Chairman. He expressed confidence in the Chairman’s commitment to upholding constitutional and democratic values, hoping for a fair resolution.

The delegation included notable figures such as former MLA Kishore Kumar Munna, former MLC Rambali Chandravanshi, Subhash Kushwaha, Tej Narayan Sahni, Suresh Patel, and Obaidur Rahman.
