
Mumbai, February 18: The Bombay High Court held a hearing on two significant petitions related to Vijay Mallya on Tuesday. During the proceedings, Mallya’s lawyer informed the court that they could not specify when he might return to India, as English courts have imposed restrictions on his departure from the country.
The hearing took place before a bench comprising Chief Justice Chandrachud and Justice Gautam Ankhad. Mallya’s petitions challenge his designation as a “fugitive economic offender” and contest the order declaring him a proclaimed economic offender.
Senior advocate Amit Desai, representing Mallya, argued that several Supreme Court rulings have allowed petitions to be heard in the absence of the petitioner. He pointed out that extradition proceedings against his client are ongoing in England, preventing him from traveling.
However, the Chief Justice raised questions about Mallya’s intention to appear in court. The bench noted that while Mallya cited the orders from the English court, it remained unclear whether he had formally challenged those orders. The court viewed this as a potential excuse.
During the hearing, the court directed Solicitor General Tushar Mehta to file a response to Mallya’s affidavit. The bench also stated that the statements made in court should be submitted as an affidavit to ensure they are recorded, allowing the central government to respond accordingly.
The bench granted three weeks for further proceedings and commented that these petitions have been pending since 2019, with no serious efforts from the petitioner for their expedited resolution. The next hearing is scheduled for March 11.
