Supreme Court Issues Strict Transparency Orders on Tamil Nadu SIR Process

The Supreme Court has issued important directions to ensure transparency in the Special Intensive Revision (SIR) process underway in Tamil Nadu.

A bench comprising Chief Justice Surya Kant and Justice Joymalya Bagchi observed that the list of nearly 1.16 crore people receiving notices due to ‘logical discrepancies’ must be made publicly accessible.

The court directed that this list be displayed at village panchayat offices, block offices in every taluka, and ward offices in urban areas. This measure aims to help affected individuals easily verify the discrepancies mentioned against their names. The list should also include a brief reason for each discrepancy.

Further, the Supreme Court instructed every district collector in the state to strictly adhere to the Election Commission of India’s guidelines. Collectors must ensure adequate staffing to smoothly conduct the SIR process. Police chiefs have been directed to maintain law and order and ensure the process proceeds peacefully.

Offering relief to those on the discrepancy list, the court allowed individuals or their authorised representatives to submit documents within ten days of the list being displayed. Grievances can be filed at the offices at the sub-division level.

The Chief Justice expressed hope that the Election Commission will enforce these directives rigorously wherever the SIR is ongoing.

This ruling comes amid concerns raised during the Tamil Nadu SIR about transparency and complaints from many who did not receive notices or faced procedural lapses. The court has also paved the way to apply similar instructions as given earlier in the West Bengal SIR case to Tamil Nadu.
