Rajasthan HC Dismisses Plea Against PM Modi, Amit Shah; ₹50,000 Cost Imposed

Jaipur, September 24 (Udaipur Kiran News): The Rajasthan High Court has dismissed a petition filed against Prime Minister Narendra Modi, Union Home Minister Amit Shah, and former Law Minister Ravi Shankar Prasad in connection with the Citizenship Amendment Act (CAA). The court also imposed a cost of ₹50,000 on the petitioner.

Justice Sudesh Bansal’s single bench passed the order while rejecting the criminal petition filed by advocate Puran Chandra Sen. The court further said that the respondents, including PM Modi and Shah, are free to initiate legal action against the petitioner if they wish.

The court observed that the right to seek justice cannot be misused as a license to file frivolous petitions. It noted that an advocate is expected to verify facts before approaching the court and should not act in a manner aimed at gaining cheap popularity.

The bench also underlined that the petitioner’s allegations not only tarnished the image of the respondents but also attempted to incite communal tension. The court clarified that the mere filing of such a complaint does not establish that the passage of the CAA created disorder in the country.

The petition had claimed that the CAA was unconstitutional and brought with the intent of oppressing Muslims and secular-minded citizens, creating an atmosphere of hostility. However, Solicitor General Tushar Mehta and Additional Solicitor General R.D. Rastogi, appearing for the Centre, argued that laws are framed by Parliament, not by the Prime Minister, Home Minister, or Law Minister individually. Therefore, the allegations against them were baseless and amounted to misuse of law.

Advocate General Rajendra Prasad also supported the lower court’s earlier dismissal of the complaint, stating that the matter did not fall under its jurisdiction.
