New Delhi, March 26: Fugitive diamond trader Nirav Modi faced a significant setback when the King’s Bench Division of the High Court in London dismissed his application to reopen proceedings against his extradition order to India.
The case was represented by a lawyer from the Crown Prosecution Service, supported by a dedicated team from the Central Bureau of Investigation (CBI), which included investigators who traveled to London to assist in the hearing.
Modi’s request to reopen the case was based on a previous ruling involving Sanjay Bhandari, a middleman, where the UK High Court rejected his extradition on humanitarian grounds, citing the risk of torture if returned to India.
Citing this precedent, Modi argued that he too would face torture if extradited. However, CBI officials countered this claim during the proceedings.
In its ruling, the UK High Court determined that Modi’s application did not meet the criteria for extraordinary circumstances required to reopen the case. The court stated that the grounds presented were insufficient, making it inappropriate to reconsider the earlier decision.
Nirav Modi is wanted in connection with the Punjab National Bank fraud case, where he allegedly obtained foreign loans using fake guarantees issued in the name of the state-run lender. He fled India in January 2018, just before the CBI began its investigation into the scam.
Following his arrest in the United Kingdom in 2019, British courts approved his extradition to India. The courts accepted assurances regarding his treatment in India and found no legal obstacles to his extradition, resulting in the dismissal of his previous appeals.
