Gwalior, March 10: The Gwalior bench of the Madhya Pradesh High Court has declared the election of Congress MLA Mukesh Malhotra from the Vijaypur constituency void. The court has instead recognized the defeated candidate, Ramnivas Rawat, as the duly elected MLA.
Malhotra now has the option to appeal this decision in the Supreme Court.
The elections in the state were held in 2023, where Congress candidate Mukesh Malhotra defeated BJP’s Ramnivas Rawat. Rawat alleged that Malhotra concealed information about pending criminal cases in his affidavit submitted to the Election Commission. This prompted Rawat to file a petition in the Gwalior bench.
After hearing the case, the court found merit in Rawat’s claims and declared Malhotra’s election void. Malhotra’s attorney informed reporters that the petition alleged that Malhotra hid details about two types of cases—one that had been resolved with a conviction and another where he was acquitted by the trial court. The attorney claimed there are additional cases against Malhotra that were not disclosed.
The court deemed the concealment of case information as a serious malpractice, leading to its ruling. While the election has been annulled, Ramnivas Rawat has been declared the MLA. Malhotra is expected to appeal this decision to the Supreme Court and has also filed for a stay on the ruling in the High Court.
Reacting to the Gwalior bench’s decision, opposition leader Umang Singhar stated that the court’s ruling to nullify Mukesh Malhotra’s election was based on incomplete information provided in the affidavit. He emphasized that the Congress party respects the court’s decision.
Singhar further noted that the Congress party will consult with legal experts and understand the legal implications before appealing to the Supreme Court. He asserted that the people of Vijaypur had given a mandate to the Congress party and remain supportive. The party is hopeful of receiving justice from the Supreme Court.
