Washington, Sept 10 (Kiran News): The Trump administration has appealed lower court rulings striking down several of its sweeping tariffs, and the U.S. Supreme Court has agreed to hear the matter on an expedited basis.

According to a report by CNBC, the court announced on Tuesday that it will hold oral arguments in the first week of November, allotting one hour for the session. The justices have combined two separate cases: one filed by seven small businesses and another involving appeals from 12 U.S. states, both of which had earlier secured favorable rulings in lower courts.
$750 Billion–$1 Trillion at Stake
The administration warned that if the Supreme Court upholds the lower courts’ findings by June next year, the Treasury Department could be forced to refund between $750 billion and $1 trillion in collected tariffs. At the center of the case are so-called “reciprocal tariffs” announced by Trump on April 2.
These duties ranged from a 10% baseline on multiple imports to as high as 50% on imports from Brazil and India, with some goods from Canada, China, and Mexico facing tariffs of 25%. Trump said the tariffs were meant to hold countries accountable for allowing the flow of the lethal drug fentanyl into the United States.
Lower Courts Question Presidential Authority
On August 29, the U.S. Court of Appeals for the Federal Circuit, in a 7-4 decision, ruled that Trump had exceeded presidential authority by imposing broad tariffs without congressional approval. The court upheld an earlier decision by the Court of International Trade, which concluded that while the president may regulate imports during a national emergency under the International Emergency Economic Powers Act (IEEPA), that power does not extend to imposing open-ended, global tariffs.
The Supreme Court’s decision in this case could have significant consequences not only for Trump’s trade policy but also for the scope of presidential authority in regulating international commerce.
