
New Delhi, October 2 (Daily Kiran) : The Supreme Court is set to hear petitions against Chief Election Commissioner (CEC) Gyanesh Kumar on October 5. This session will be conducted by a bench led by Chief Justice D.Y. Chandrachud, alongside Justices Joymalya Bagchi and V. Mohan.
The petitions challenge alleged unilateral decisions related to the Special Information Report (SIR), claiming these actions and modifications to guidelines and software are unconstitutional. The petitioners are demanding legal action against Gyanesh Kumar and other officials.
Specifically, the petitions assert that approximately 130 million names have been removed from the voter list during the SIR process. They call for a Special Investigation Team (SIT) or judicial inquiry, headed by a retired Supreme Court judge, to investigate the matter.
Additionally, the petitioners are requesting a forensic audit of the Election Commission’s ECI-Net and ERO-Net systems. They seek clarification from CEC Gyanesh Kumar regarding the legal basis for exercising the commission’s collective authority. The petitions also demand access to the ECI’s original records, file notings, and minutes of meetings.
One of the primary requests is to suspend Gyanesh Kumar from his position as CEC until the hearings are concluded. The petitioners argue that if decisions related to the SIR were made unilaterally and software changes were implemented, it poses a threat to democracy. They urge the court to conduct a thorough investigation and bring forth the records of the Election Commission.
As the date approaches, all eyes are on the Supreme Court’s hearing on October 5, with anticipation regarding the bench’s stance on this significant issue.
