NHRC Takes Action Against Insurance Denials for Disabled Individuals

New Delhi, March 24: The issue of disabled individuals, particularly those with speech and hearing impairments, being denied life insurance benefits has come to light in India. In response to this complaint, the National Human Rights Commission (NHRC) has issued a notice to the Insurance Regulatory and Development Authority of India (IRDAI), demanding an action taken report (ATR) within 15 days.

The NHRC bench, led by Priyank Kanungo, has deemed this matter a serious violation of human rights. The complaint alleges that insurance companies are refusing to provide life insurance to disabled children, especially those who are deaf-mute, or are imposing stringent conditions. This has led to increased financial insecurity for these families, denying disabled children their rightful financial protection.

The complaint was filed by an official from the Small Industries Association in Ludhiana, Punjab. The complainant stated that insurance companies are discriminating against individuals with disabilities by denying policies based on their condition. They have urged the regulatory body to issue clear guidelines to prevent disability from being a reason for denial of insurance. Additionally, there is a call for the development of inclusive insurance products specifically for disabled individuals and for raising awareness among insurance companies.

The NHRC has acted under the Protection of Human Rights Act, 1993, directing the IRDAI to investigate the allegations made in the complaint and submit a detailed report to the commission within 15 days.

A copy of this entire matter has also been sent to the Financial Services Department of the Ministry of Finance. The NHRC has instructed the IRDAI to send a copy of its report via email as well.
