
The National Human Rights Commission (NHRC) has taken a serious note of the devastating fire incident at the ‘Wow! Momo’ warehouse-factory located in Anandapur, Kolkata. The commission has urged the West Bengal government to take immediate action regarding the tragedy.
NHRC has issued a notice to the District Magistrate of Kolkata, directing a detailed Action Taken Report (ATR) within three days. This notice has been issued under Section 12 of the Protection of Human Rights Act, 1993, highlighting that prima facie, the incident appears to violate the human rights of the victims.
According to the complaint, a sudden fire broke out at the ‘Wow! Momo’ warehouse on January 26, while several workers were asleep inside the premises. The fire claimed the lives of at least 20 workers, with several others still missing.
The complainant has accused the management of ‘Wow! Momo’ of criminal negligence. Questions have also been raised about the roles of the Fire Services, Labour Department, Urban Planning Authority, and local administration, alleging regulatory failure by these bodies led to the incident.
The complaint cites violations of various legal provisions including the Factories Act, 1948, the Code on Occupational Safety, Health and Working Conditions, 2020, the Disaster Management Act, and Article 21 of the Indian Constitution.
The complainant has requested the NHRC to order an independent, high-level inquiry, hold responsible officials and management accountable, ensure compensation and rehabilitation for the victims’ families, and conduct safety audits across the state.
The NHRC bench, headed by member Priyank Kanungo, has taken cognizance of the matter and instructed the Kolkata District Magistrate to investigate the allegations and submit the report within three days. A copy of the report is also to be sent via email. Further action will be determined based on the findings.
