Bhopal, April 17: In a significant move aimed at strengthening the rights of arrested individuals, the Madhya Pradesh Police has implemented a new policy. Under this regulation, police officers are now required to provide a written basis for every arrest made.
The Madhya Pradesh Police Headquarters in Bhopal has issued directives to all police commissioners, superintendents, and field units to enforce this reform. This step is in compliance with recent guidelines from the Supreme Court.
In its order dated November 6, 2025, the Supreme Court emphasized that informing any accused person of the reasons for their arrest is a fundamental right, as enshrined in Article 22(1) of the Constitution.
According to the circular, police officials must now provide clear and specific written reasons for arrests. Merely giving verbal information will no longer suffice. This information must be communicated in a language that the arrested individual can understand, ensuring transparency and eliminating any confusion.
The circular states that police must provide written reasons for an arrest at the time of the arrest or, at the latest, within two hours before presenting the accused before a magistrate. Additionally, police are required to document that these written reasons have been provided.
These directives align with the provisions of the Indian Citizen Security Code, 2023.
The headquarters has clarified that failure to comply with these regulations may render the arrest illegal, potentially leading to contempt of court or departmental action. In such cases, immediate release of the accused may also be possible.
Senior officials have been instructed to strictly enforce these guidelines to ensure a robust police system while safeguarding the fundamental rights of citizens.
