
New Delhi, April 10: The Supreme Court held a significant hearing on the controversy surrounding the freezing of the voter list during the Special Intensive Revision (SIR) in West Bengal. Petitioners requested urgent intervention from the court regarding their filed petitions. However, the court clarified that it would only consider the issue on April 13.
The court also stated that it cannot provide immediate assurances on cases filed daily. Therefore, the hearing will take place on the scheduled date.
During the proceedings, it was raised that some individuals had been excluded from the voter list despite pending appeals. Chief Justice D.Y. Chandrachud remarked that affected individuals are not being permanently deprived of their voting rights. A lawyer representing the petitioners argued that the Election Commission froze the voter list on April 9, while several appeals remain pending. He noted that in some cases, appeals have already been accepted, suggesting a lack of adequate discretion in the decision-making process.
Justice Joymalya Bagchi, part of the bench, stated that the issue of freezing will be discussed in detail on April 13. The petitioner’s lawyer further contended that the Election Commission has stated that no new claims will be considered after April 9, while their clients are in a similar position to those whose appeals were accepted earlier.
The hearing also highlighted the necessity of adhering to the established cut-off date for the electoral process, while emphasizing that inclusion in the voter list and the right to vote are fundamental constitutional rights. The court indicated that balancing these two aspects is crucial. The next hearing is scheduled for April 13, where further directions regarding the ongoing controversy in West Bengal will be determined.
