
Srinagar, March 12: In a significant development in the Jammu and Kashmir Cricket Association (JKCA) scam case, the Chief Judicial Magistrate (CJM) of Srinagar withdrew the non-bailable warrant against former Chief Minister Farooq Abdullah just hours after it was issued.
The CJM made this decision considering Abdullah’s condition following a life-threatening attack the previous day. The warrant had been issued because Abdullah failed to appear in court, either in person or online.
Abdullah’s lawyer, Ishtiaq Khan, filed an application requesting the withdrawal of the warrant. He stated that medical consultants had advised Abdullah against traveling after the attack he suffered in Jammu.
In the application, Khan noted, “The physical and psychological aftershock has severely worsened the applicant’s pre-existing medical conditions, including fluctuations in blood pressure and heart issues.”
Khan further explained that following the attack, Abdullah was under strict clinical observation and security protocols. Medical consultants had imposed a strict travel ban between Jammu and Srinagar, particularly against air or road travel, as it posed a serious risk to his health and life. He added, “Given these challenging circumstances, the applicant could not appear in court on Thursday.”
Previously, the court had rejected Abdullah’s request for exemption from personal appearance. It also denied a similar request from another accused, Manzoor Gajnafar Ali, and issued a non-bailable warrant against him.
Official sources revealed that the Central Bureau of Investigation (CBI) had filed a chargesheet against several accused, including Farooq Abdullah. The CBI’s investigation focused on the embezzlement within the JKCA, alleging that funds allocated for cricket development were misused during Abdullah’s presidency. Other accused include former JKCA officials Ahsan Ahmed Mirza, Mohammad Saleem Khan, and Bashir Ahmed Misgar.
The case is ongoing, with the CBI alleging misappropriation of funds amounting to several crores. The recent court action marks a significant step towards trial following the investigation into financial mismanagement.
