Delhi High Court seeks status report on probe into attack at Delhi CM’s residence

New Delhi, April 1 : Delhi High Court sought a status report in a sealed cover on the investigation into the alleged attack at Delhi Chief Minister Arvind Kejriwal’s official residence on March 30. It is alleged through a PIL that several BJP goons in the garb of a protest, launched an attack on the official residence of the CM on March 30 and videos and photographs show that such persons casually walked through the security cordon maintained by Delhi Police, kicked and broke the boom barrier, broke the CCTVs cameras with lathis, threw paint on the gate of the residence and almost climbed over the gate. Aam Aadmi Party MLA Saurabh Bhardwaj filed the Public Interest Litigation (PIL) before the Court seeking an SIT investigation into the incident. Delhi Police submitted before the court that an FIR has been registered and 8 persons have been arrested so far. Additional Solicitor General (ASG) appearing for the investigating agency submitted before the court that all the evidence relating to the case including CCTV footage shall be preserved. ASG opposed the plea of issuance of notice stating that the petition has been filed on a false presumption that no FIR has been registered in the incident. ASG further submitted that issuance of notice on this PIL will send a wrong message because the same has been filled, which has been filed by a political person and he is neither the victim nor a complainant and having no locus. Delhi High Court division bench of acting Chief Justice Vipin Sanghi and Justice Navin Chawla after hearing said, “This is a constitutional functionary we are talking about. He is the CM. We have seen the video. It is an unruly crowd. People broke boom-barrier, some even tried to climb the gate. They tried to take law in their hands. We also find that police force was inadequate and was outnumbered. Delhi High Court issued notice to investigating agency and sought a status report in a sealed cover on the investigation into the incident and adjourned the matter for April 25 for further hearing.
