
New Delhi, May 21: The Delhi High Court has reserved its decision on the petition filed by Raghav Chadha, a Rajya Sabha MP who recently switched from the Aam Aadmi Party (AAP) to the Bharatiya Janata Party (BJP). The petition seeks to protect his personality rights by requesting the removal of defamatory, misleading, and deepfake content circulating on social media.
During the hearing, the court noted a clear distinction between the commercial use of personality rights and political criticism. The court also observed that, at first glance, there appears to be no violation of Chadha’s personality rights.
The court stated, “Decisions made in the political arena may be subject to criticism. Nowadays, the reach of social media is extensive.”
Chadha’s petition primarily calls for the immediate removal of AI-generated deepfake videos, manipulated footage, fake speeches, and misleading content from social media platforms. It argues that such materials violate his personality rights and intentionally harm his image.
Throughout the hearing, the court listened to arguments from both sides. Chadha’s attorney contended that false and defamatory content about his client is continuously going viral on social media, damaging not only his reputation but also creating public confusion.
However, the Delhi High Court clarified that political criticism cannot be viewed as a violation of personality rights. Nonetheless, it acknowledged that if any content is entirely fake, deepfake, or defamatory, action can be taken against it.
This case is significant as incidents of creating fake content against MPs and public figures through deepfakes and AI tools have surged in recent years. Many politicians have also initiated legal action against such materials.
The court is expected to deliver its final ruling on this petition in the coming days, which may provide crucial guidelines regarding the responsibilities of social media platforms and the scope of personality rights.
