
New Delhi: A judge of the Delhi High Court on Wednesday recused himself from hearing a petition filed by Rani Kapoor, mother of the late businessman Sanjay Kapoor. The petition sought the cancellation of a ‘fraudulent and illegal’ family trust that allegedly deprived her of her entire property and family inheritance, including control over key companies of the Sona Group.
The civil suit was listed before Justice Vikas Mahajan, who declined to hear the matter and directed it to be listed before another bench on January 29.
The petition demands declaratory and consequential relief to declare the so-called RK Family Trust or Rani Kapoor Family Trust null and void. It also seeks a permanent injunction restraining the respondents from operating or using the trust in any manner.
According to the complaint, Kapoor is the sole beneficiary of the estate of her late husband, industrialist Dr. Surinder Kapoor, who passed away in 2015. His will was probated by the Bombay High Court in 2016, granting her ownership of all movable and immovable properties.
The suit alleges that despite this, her entire estate was covertly transferred into a new trust without her knowledge or informed consent. It states, “The plaintiff, a senior citizen, has been defrauded of her entire property, inheritance, and belongings through a complex web of illegal acts, fraud, and undue influence,” implicating multiple respondents and their late son, Sanjay Kapoor.
Further, it is claimed that she was repeatedly induced to sign documents, including blank papers, under assurances that everything was being done according to her wishes. The suit asserts, “At no point was the plaintiff informed that she was being deprived of her entire estate or removed as a beneficiary.”
The petitioner maintains that she never knowingly created such a trust nor agreed to a structure that would render her destitute during her lifetime. The complaint also alleges that control over major group companies was taken within days of Sanjay Kapoor’s death, without her knowledge.
Describing the trust as “illegal, fraudulent, and the result of a premeditated conspiracy,” Rani Kapoor has urged the Delhi High Court to restore her property to the status it was in prior to the formation of the RK Family Trust.
