New Delhi, August 12: The first hearing regarding the Red Fort blast case took place after its transfer from Patiala House Court to Rouse Avenue Court. The court instructed the National Investigation Agency (NIA) to include a brief background of all accused in the charge sheet to clarify their roles in the conspiracy.
The court noted that the NIA filed the main charge sheet on May 14, 2026, followed by a supplementary charge sheet. So far, no cognizance has been taken of the crimes listed in the charge sheet. A hearing on the charge sheet is scheduled for August 27. One of the accused, Dr. Umar Un Nabi, has passed away. He was alleged to be involved in the car blast in the Red Fort area and reportedly died in the explosion.
The court has directed the NIA to submit the death certificate and verification report related to Dr. Umar Un Nabi’s death. After receiving this report, the court will issue a clear order regarding the pending proceedings against this accused.
The previous court had instructed the examining officer to review the main and supplementary charge sheets and submit a report. The current court reiterated this order. It also directed the special public prosecutor to prepare a brief table detailing each accused’s role and the evidence gathered by the NIA against them. This will assist the court in considering the charge sheet.
The court also noted that further investigation against Ukasha, Faizal, Ashim, and Usman is pending. The NIA has been directed to report whether further proceedings can continue despite this pending investigation.
Pending applications have been registered separately from the main case for hearing on different dates to ensure they do not affect the main proceedings and expedite the case resolution. An application for an open-ended non-bailable warrant against accused A13, Muzaffar Ahmed, has already been approved, and a compliance report has been filed. The next hearing for this case is set for August 17.
A hearing regarding an application to declare protected witnesses will take place on August 24. This application has been filed under Section 44 of the UAPA and Section 17 of the NIA Act. The NIA has requested five days to respond.
Another accused has requested phone access to communicate with his father. The jail superintendent has been instructed to report on the availability of telephone facilities in jail during the court session. This hearing will occur on August 19.
An application from another accused regarding phone calls and e-meetings could not be found in the records. The court has directed the examining officer to locate the application and present it on the relevant date. The main case will now be heard on August 27, when the court will consider the NIA’s charge sheet.
