Patna, July 22: RJD MLA Osama Shahab, representing the Raghnathpur constituency in Siwan district, received significant legal relief on Tuesday when the Patna High Court granted him anticipatory bail in a land dispute case.
This new ruling eliminates the immediate possibility of his arrest, replacing the interim protection previously granted by the court.
The case pertains to a disputed piece of land in the village of Jhunapur, under the jurisdiction of the Mahadeva police station in Siwan district.
On April 15, 2026, Sudha Singh and her husband Vinay Kumar Singh, residents of Gopalganj, filed an FIR. They accused Osama Shahab of obstructing construction on land they purchased in September 2024, claiming that Shahab asserted ownership over the property.
According to the complaint, the plaintiffs initially received phone calls urging them to halt construction. Subsequently, a group of 30-40 individuals allegedly arrived at the site.
The group is accused of assaulting workers, vandalizing CCTV cameras, and seizing mobile phones and a cutting machine.
Based on these allegations, the Mahadeva police registered an FIR against Osama Shahab, Farhan, Sabir, and 30-35 unidentified individuals under various legal provisions.
On April 28, 2026, a Siwan court denied Shahab’s anticipatory bail plea, prompting him to seek relief from the Patna High Court.
During the hearing, the High Court requested the police case diary and imposed an interim stay on his arrest, preventing any harsh actions while the case was under consideration.
Before receiving interim protection from the High Court, a police team led by SDPO Ajay Kumar Singh visited Shahab’s residence in the Kotwali police station area of Patna. However, the MLA was not present. His associates informed the police that the High Court had already stayed his arrest and presented the relevant court order.
In court, Osama Shahab argued that the disputed land was registered in his wife Ayesha’s name in January 2023, and construction was halted due to an ongoing ownership dispute already under judicial review.
Subsequently, a second document (sale deed) favoring Vinay Kumar Singh and Sudha Singh was allegedly prepared, leading to the current dispute.
After hearing arguments from both sides on Tuesday, the Patna High Court granted anticipatory bail to Osama Shahab. This order transformed the previously granted interim protection into regular legal relief, ensuring that he would not be arrested in this case as long as he complied with the bail conditions.
However, this court order does not conclude the matter. The police investigation will continue, and legal proceedings related to the land dispute will progress according to the law.
