
New Delhi, March 16: The Supreme Court is set to hear a public interest petition demanding the establishment of a Legal Education Commission. The court has assured that the hearing will take place in May. It acknowledged the petition’s merit and indicated that it could be considered further.
The petition, filed by Advocate Ashwini Upadhyay, calls for the formation of a commission comprising renowned legal experts. This commission would be tasked with developing new syllabi and curricula to modernize legal education and make it accessible to all.
The petition highlights that most law courses in India still operate as five-year integrated BA-LLB or BBA-LLB programs. Advocate Upadhyay pointed out that while many courses are typically four years long, the five-year duration adds both time and financial burdens on students. This is particularly challenging for students from low- and middle-income families, who struggle with the extended duration and associated costs. He emphasized that this lengthy course structure fails to attract the best talent.
Chief Justice of India, D.Y. Chandrachud, remarked that legal education is a distinct issue, and the quality of legal education is another matter altogether. He acknowledged the petition’s validity and noted that the best talent has always been present in the field.
The petition further argues that the five-year course has become outdated and financially burdensome. The National Education Policy promotes four-year undergraduate programs, yet legal education remains tied to older integrated courses. The petition asserts that transitioning to a four-year legal education program would save students both time and money, making it easier to attract talented individuals.
