Supreme Court to Hear Controversy Over One-Vote Victory in Tamil Nadu

New Delhi, May 13: The Supreme Court will hear a petition filed by R. Srinivasa Setupati, a legislator from the Tamilaga Vetrikazhagam (TVK), on Wednesday. This petition challenges an interim order from the Madras High Court that barred him from participating in a floor test in the Tamil Nadu Assembly amid a dispute over his narrow victory in the Tirupattur constituency by just one vote.

According to information available on the Supreme Court’s official website, Setupati’s petition has been listed for hearing before a bench comprising Justices Vikram Nath, Sandeep Mehta, and Vijay Bishnoi.

Senior advocate Abhishek Manu Singhvi requested an urgent hearing of this petition before Chief Justice of India (CJI) D.Y. Chandrachud on Tuesday. Following this, the Supreme Court agreed to list the matter for Wednesday’s hearing.

The case revolves around the recent assembly elections in which Setupati defeated former Tamil Nadu minister and DMK leader K.R. Periyakaruppan in the Tirupattur constituency. Official figures from the Election Commission of India indicate that Setupati received 83,365 votes, while Periyakaruppan garnered 83,364 votes.

After the election results, the DMK leader alleged serious irregularities in the counting process and approached the Madras High Court. Periyakaruppan claimed that a postal ballot sent for the Tirupattur assembly constituency number 185 was mistakenly delivered to Tirupattur assembly constituency number 50 in Vellore district, where it was rejected instead of being returned to the correct constituency.

Subsequently, the High Court issued an interim order preventing Setupati from participating in crucial assembly proceedings. Currently, Setupati has challenged the interim order passed by the vacation bench of the Madras High Court in the Supreme Court, which will be heard on Wednesday.
