Supreme Court disposes of Amazon SLP

New Delhi, April 6 : The Supreme Court on Wednesday disposed of the Special Leave Petition (SLP) filed by Amazon group challenging the Delhi High Court’s January 5 order staying the arbitration proceedings in the Singapore International Arbitration. A three-judge Bench headed by Chief Justice N V Ramana has ordered that the parties should approach the arbitral tribunal to resume the arbitration proceedings on the understanding that it will hear Future Retail Ltd’s termination application. The Supreme Court has also ordered Future Retail and Amazon to transmit the intervention application to a single judge to pass the appropriate order. Both the parties, Future Retail and Amazon, have agreed to the order passed by the Supreme Court. Tired of the multi-layers litigation between Amazon-Future over retail assets of Future, CJI Ramana said: “I hope there will not be a need for me to hear this issue during my tenure as CJI.” Both the companies — Amazon and Future Group — have fought over each other in many legal forums, including the Delhi High Court, NCLAT (National Company Law Appellate Tribunal) and others, over assets, violation of agreement and other issues.
