
New Delhi, February 3: The Supreme Court has sternly reprimanded WhatsApp and its parent company Meta regarding data sharing practices. The court made it clear that there will be no compromise on the privacy of citizens under the guise of data sharing. Chief Justice Suryakant stated that the court will not permit WhatsApp to share any information with other companies.
Lawyers representing WhatsApp argued that users have the option to reject the terms. However, the Chief Justice questioned how an average person could comprehend such complex terms. He illustrated this by asking how a street vendor selling vegetables would understand terms and conditions written in English. The court accused Meta of being solely profit-driven, acknowledging that users have become addicted to WhatsApp, which is widely used. Yet, the misuse of personal information continues.
The Chief Justice pointed out that while Meta understands its business interests, it also knows how it has made consumers dependent on the app. He raised concerns about a person in a remote Tamil Nadu village, who only understands their local language, and how they would grasp the terms. The court demanded an undertaking from Meta that it would not share user information before proceeding with the merits of the case.
He emphasized that WhatsApp is meant for messaging and communication, not for collecting and selling data. He cited examples where advertisements appear shortly after receiving a prescription from a doctor, highlighting the misuse of data.
Justice Bagchi remarked that the Digital Personal Data Protection Act focuses solely on privacy, yet the company is utilizing data for online advertisements.
The next hearing is scheduled for February 9, where Meta is expected to submit its response, and the central government will also provide its feedback. This case pertains to WhatsApp’s 2021 privacy policy, which has sparked controversy over data sharing. The court has taken a strong stance on protecting user privacy.
