Jaipur, April 17: The Rajasthan High Court has made a significant ruling regarding compassionate appointments, affirming that daughters-in-law possess the same rights as daughters. This decision is viewed as a step towards enhancing gender equality and providing legal clarity on the matter.
While hearing a petition filed by Sundari Devi, Justice Ravi Chirania instructed the relevant department to grant her compassionate appointment without delay. The court also made it clear that strict action would be taken against officials who fail to comply with this order.
The court noted that a division bench had already clarified in 2023 that daughters-in-law have equal rights in cases of compassionate appointments. Despite this, the department’s repeated technical objections were deemed inconsistent with judicial principles, causing unnecessary delays in justice.
Sundari Devi is the daughter-in-law of an employee in the Public Works Department, who passed away on November 19, 2016, while in service. At that time, her husband was bedridden due to a severe accident. To support her family, Sundari Devi applied for a compassionate appointment, but the department failed to make a decision on her application.
The situation worsened when her husband passed away on May 25, 2020, leaving the entire family dependent on her. Despite this, the department continued to keep her petition pending, raising objections on issues that the judiciary had already clearly addressed.
The High Court has ordered the department to appoint Sundari Devi within 30 days, emphasizing that any delay will not be tolerated. Additionally, the court instructed the submission of a compliance report within 45 days.
The court warned that failure to comply with the order or any unnecessary delays could lead to contempt proceedings against the relevant officials.
This ruling is considered a milestone for women’s rights, especially for those women who are shouldering family responsibilities under challenging circumstances.
