Kolkata High Court Bar Association Condemns Malda Incident, Suspends Involved Lawyer

New Delhi, April 8: The Kolkata High Court Bar Association has strongly condemned the alleged attack on judicial officials in Malda district, West Bengal. On Tuesday, the association passed a resolution suspending one of its members and demanding strict action against those involved in the incident.

During the assembly, serious concerns were raised regarding the attack that occurred on the morning of April 1 in Kaliyachak, Malda. Seven judicial officers were reportedly held hostage for nearly nine hours during a Special Intensive Review (SIR) exercise.

The resolution stated, “We, the members of the Kolkata High Court Bar Association, are deeply disturbed by this horrific and despicable attack on the judiciary and its organs.” The Bar Association labeled the incident as a serious and abhorrent criminal act, asserting that such attacks cannot be tolerated and are a deliberate attempt to instill fear across the state. Concerns were also expressed regarding the alleged inaction of the police.

It was noted that the police administration appeared to be mere spectators, allowing this brutality and uncontrolled violence to continue for almost nine hours.

The resolution identified lawyer Mofakkerul Islam as the main perpetrator and instigator of the mob. He was a member of the Bar Association. In response to this act, the association decided to suspend Islam’s membership with immediate effect.

The resolution further stated that, given the circumstances, the Bar Association unanimously suspends lawyer Mofakkerul Islam from its prestigious membership until criminal proceedings are completed.

Additionally, disciplinary action will be initiated for his expulsion, and a request will be made to the Bar Council of West Bengal to de-enroll him.

The resolution concluded, “We will urge the Bar Council of West Bengal to de-enroll this criminal lawyer for his actions, which are against the ethics of an educated lawyer.”

Meanwhile, taking the incident seriously, the Supreme Court directed the National Investigation Agency (NIA) to investigate the Malda case under Article 142 of the Constitution.

A bench led by Chief Justice D.Y. Chandrachud stated that the allegations against the West Bengal police warrant an independent investigation. The NIA has been ordered to probe all 12 FIRs related to the incident.

The Supreme Court also permitted the NIA to file additional FIRs if a broader conspiracy is uncovered, to present regular status reports to the court, and directed the state police to provide all evidence and full cooperation.
