New York, February 21: U.S. business groups, advocacy organizations, and legal experts have welcomed the Supreme Court’s ruling on tariffs. The court invalidated President Donald Trump’s use of emergency powers to impose tariffs. Advocacy and business groups view this decision as a reaffirmation of congressional authority and a relief for businesses.
In a 6-3 decision, the Supreme Court ruled that the executive branch misused its authority by applying import taxes on most trading partners through emergency powers, deeming several tariffs from the previous year illegal.
Neil Bradley, Executive Vice President and Chief Policy Officer of the U.S. Chamber of Commerce, stated on Friday that this ruling is good news for businesses and consumers. He noted that tariffs have significantly increased costs for companies and disrupted supply chains.
Bradley urged the government to promptly refund duties collected unlawfully and to reset the entire tariff policy to promote economic growth and reduce costs for families.
The We Pay the Tariffs union, which advocates for small businesses, also called for full, swift, and automatic refunds, highlighting that many of its members paid billions in duties that should never have been imposed.
According to a report from the Xinhua news agency, Republican Senator Mitch McConnell from Kentucky also welcomed the ruling. In a statement, McConnell remarked, “The hollow benefits of a major trade war with America’s allies were clear long before today’s decision. Americans already know that when Washington imposes artificial barriers, it makes buying and making things at home more expensive.”
Edward Fishman, a former State Department and Treasury official now with the Council on Foreign Relations, indicated that this ruling could reduce the use of tariffs as a rapid-response geopolitical tool, although they may still be employed in trade negotiations through other legal means.
Some business groups have warned that uncertainty remains, expressing concerns that tariffs could be reapplied through different legal avenues.
