
New Delhi, February 19: The Supreme Court has sent petitions related to the implementation of the 27% reservation for Other Backward Classes (OBC) in Madhya Pradesh back to the High Court. On Thursday, the Supreme Court made it clear that the High Court will now make the final decision on this matter.
This law was passed by the state assembly in 2019, increasing the reservation for OBCs in government jobs and educational institutions from 14% to 27%. However, delays in implementation and various challenges have kept the case tied up in courts for an extended period.
The petitioners are primarily candidates from the Madhya Pradesh Public Service Commission. They complained to the Supreme Court that despite no stay on the law, the state government and the commission have withheld 13% of the positions in recruitments conducted over the past few years. These positions remain unfilled.
The petition demands that the recruitment process be completed by applying the 27% OBC reservation to the withheld positions. The candidates allege that the government is deliberately not implementing this law, causing harm to OBC applicants.
During the hearing, the Supreme Court stated that the local conditions, population data, and other significant aspects are better understood by the High Court. Therefore, all related petitions are being sent back to the High Court. The court also instructed that the cases be resolved as quickly as possible to end the long wait for the candidates.
This decision is crucial for millions of OBC youth in Madhya Pradesh who are awaiting reservation in government jobs. There has also been controversy over the total reservation exceeding the 50% limit in the state. The Supreme Court clarified that the final decision on implementing the law will depend on the state government’s policy and the High Court’s ruling.
