Supreme Court Denies Hearing on Tarun Murder Case and Family Security Petition

New Delhi, March 25: The Supreme Court has declined to hear a petition related to the investigation of the murder of a young man named Tarun, which occurred during Holi celebrations in Uttam Nagar, Delhi. The petition was filed by lawyer Harishankar Jain.

The Supreme Court advised the victim’s family to present their security concerns to the Delhi Police Commissioner and to approach the Delhi High Court if necessary. The court stated that if the police fail to address the complaint, the petitioners could seek relief from the High Court.

The petition also requested security for the victim’s family and compensation of ₹5 crore. It argued that the incident should be classified as mob lynching, invoking the precedent set by the Tahseen Poonawalla case.

Lawyer Harishankar Jain emphasized, “A brutal act of lynching has occurred, resulting in the loss of a young life.”

Chief Justice of India (CJI) D.Y. Chandrachud noted that CBI officials frequently visit but often claim to be overwhelmed with work. He remarked that the Delhi Police are professional and should not be discouraged. He suggested that if the police need to be made more sensitive to the situation, the petitioners should first contact the Police Commissioner.

The court indicated that certain directives regarding the victim’s family’s safety are administrative in nature and can be managed by the Delhi Police. The petitioners are permitted to submit an application to the Police Commissioner. It is clear that if the police perceive any threats, they will take necessary protective measures. If no action is taken, the petitioners may approach the Delhi High Court.

It is important to note that the dispute arose on March 4 during Holi when some color splashes accidentally landed on a woman from another community. The family claims they apologized to the woman. However, the woman, along with her family and relatives, attacked the family celebrating Holi, during which Tarun was killed.
