Jaipur, 19 August (Kiran News). The Rajasthan High Court has stated that teachers previously selected in the Third Grade Level 2 Teacher Recruitment-2022 should not be removed due to the revised exam results. The division bench of Justice Indrajeet Singh and Justice Bhuvan Goyal passed this order while hearing appeals filed by Vinesh Kumar, Swati Bhatt, and others.
In the appeal, advocate Harendra Neel informed the court that the appellants were selected in the Third Grade Level 2 Teacher Recruitment-2022. Later, some questions from the recruitment exam were challenged in the High Court. During the hearing, the single bench directed the formation of an expert committee to examine the disputed questions. The single bench also ordered that if anyone is excluded in the revised result, they should not be appointed. Following this, the Staff Selection Board released the revised results on 27 January, in which the appellants were excluded from the merit list.
Challenging the single bench’s order, it was argued that a previously selected candidate can only be removed from appointment if the selection was due to fraud, misconduct, or misrepresentation. The appellants were selected and appointed by the Staff Selection Board itself. If a revised result is released, the fault lies with the Selection Board, not the appellants. Therefore, the appellants should not be punished for the board’s mistake. It was also argued that the single bench passed the order against them without hearing their side. The Supreme Court has also ruled that if a revised result is issued without the candidate’s fault, previously selected candidates cannot be removed from service. Considering these arguments, the division bench has stayed the removal of previously selected teachers. Notably, after the revised result, about 1,235 previously selected teachers were removed.
