Petition Filed Against Chief Election Commissioner Gyanesh Kumar in Supreme Court

A Public Interest Litigation has been filed against Chief Election Commissioner Gyanesh Kumar, alleging illegal decisions and voter list discrepancies.

New Delhi, September 25 (Daily Kiran) : A Public Interest Litigation (PIL) was filed in the Supreme Court on September 25, 2026, against Chief Election Commissioner Gyanesh Kumar. The petition is based on various media reports highlighting concerns over the decision-making process within the Election Commission.

The petition alleges that significant decisions related to the Special Intensive Revision (SIR) were made without the consent of the other two election commissioners. The petitioner demands that these decisions be declared illegal and that the original Form-6 be reinstated.

Additionally, the petition calls for a Special Investigation Team (SIT) to investigate how the names of 13 million voters were removed from the electoral rolls. The petitioner argues that such a large-scale removal is unusual and warrants an impartial inquiry.

The PIL also seeks to initiate legal action against several officials for violations of duties under the Representation of the People Act. This includes Gyanesh Kumar, along with Manish Garg, an IAS officer and Deputy Election Commissioner, and Seema Khanna, head of IT at the Election Commission of India.

The petition states that these officials have breached regulations, thus necessitating legal consequences.

Meanwhile, in Chandigarh, the Congress party staged a significant protest demanding Gyanesh Kumar’s resignation. Amid heavy security, Congress workers took to the streets, chanting for the Chief Election Commissioner‘s removal. Police had to deploy water cannons to manage the situation and detained several party members.

Congress alleges that the current Chief Election Commissioner’s tenure has undermined democratic processes, with mass deletions from the voter list. The party has vowed to continue its protests until Kumar resigns.
