Hyderabad, August 26: AIMIM President Asaduddin Owaisi has launched a strong critique against the implementation of the Uniform Civil Code (UCC) in Uttarakhand, Assam, and Gujarat. He also expressed sharp disapproval of the Allahabad High Court‘s ruling regarding the hijab.
During a significant gathering at the AIMIM headquarters in Darussalam, Owaisi stated that the UCC is being imposed on Muslims. He questioned, “The UCC has been implemented in Uttarakhand, Assam, and Gujarat. If these laws are based on the Hindu Marriage Act, Hindu Divorce Act, and Hindu Succession Act, how can they truly be called a Uniform Civil Code? Why should these laws, rooted in Hindu personal law, be imposed on Muslims?”
Owaisi emphasized that attempts to separate Muslims from their religious beliefs will not succeed. He affirmed that those who follow Islam will continue to adhere to the teachings of the Quran and Sunnah. He stated, “Remember, attempts to distance us from our faith will fail. Those who believe in Islam will continue to follow the teachings of the Quran and Sunnah. We will not abandon our religion.”
He also criticized the Allahabad High Court’s decision, which dismissed a petition from a minor student seeking permission to wear a hijab with her school uniform. He labeled the court’s ruling as “an attack on Islam” and questioned whether the High Court should have issued such an order. He pointed out that the Sabarimala case is pending in the Supreme Court, which is reviewing issues related to essential religious practices.
“I disagree with the Allahabad High Court’s ruling. Today’s decision violates Articles 25 and 19 of the Indian Constitution. Who are you to decide what is essential for Islam? Girls wear hijabs on their heads, not on their minds. This is an attack on Islam,” he asserted.
The Allahabad High Court stated that the petitioner failed to present any religious texts or materials to prove that wearing a scarf is an “essential” part of her religion, without which her faith would be adversely affected. The court also noted that images presented in the case showed other students from the same religious community attending school without scarves.
Owaisi reaffirmed his commitment to India, stating that Muslims will continue to protect their faith while contributing to the nation’s development. He remarked, “We love this country, we will protect it, and while remaining committed to our faith, we will work to make India a superpower. The struggle for India’s independence also belongs to those who sacrificed their lives for the country, including freedom fighters like Turrabaz Khan. Their sacrifices should not be forgotten.”
He also launched a fierce attack on the RSS and BJP, accusing these organizations of historically prioritizing Manusmriti over the Indian Constitution. Owaisi questioned those associated with the RSS about Manusmriti, stating, “Is it not true that we adopted the Constitution on November 26, 1949? However, four days later, on November 30, an RSS mouthpiece published a complaint against it, claiming that ‘this was not the Constitution and it should have been Manusmriti instead.’ They had issues with the Constitution drafted by Babasaheb Ambedkar.”
