Mumbai, Mar 12 : The Bombay high court on Friday reserved its order till March 15 on a petition filed by Maharashtra Minorities Affairs Minister Nawab Malik, an accused in a money laundering case claiming that his arrest is illegal and seeking quashing of the Special Court’s order. The division bench consist Justice P B Varale and Justice S M Modak reserved its order following extensive arguments by both parties that lasted over three days۔ Sr Advocate Amit Desai appeared on behalf of Malik and had challenged the NCP leader arrest by the ED in a money laundering case involving underworld don Ibrahim Kaskar family members in a property deal. He has argued on the remand application which was moved by ED on two occasions before the PMLA court and said that remand application of the central agency is silent on the specific role played by Malik in the alleged crime. Adv. Desai argued on the issue of possession and what constituted a continuous offence. He said that in the offence of laundering, three persons are involved – one who commits theft, second who commits the laundering and the third who is in possession. Earlier, Desai had argued that the state minister’s arrest and the subsequent remands were illegal. Seeking quashing of the arrest and remand. Additional solicitor General Anil Singh opposed the petition and said that petition is not maintainable and deserve to be dismissed.
