New Delhi, Mar 3 : The Supreme Court on Thursday suggested all the respective parties, Amazon, Biyani group’s Future Retail and Coupon, and Reliance Retail, to explore the possibility in the next 10 days to settle disputes over Future’s retail assets through process of dialogue. A three-judge bench headed by the Chief Justice NV Ramana, said it will be better for each business house to settle the disputes amicably rather than indulge in multi-forum litigation. He also clarified that there would be no difficulty on top court’s part to decide the dispute judicially, which may hurt one or the other party. Future group’s senior lawyer Harish Salve and Mukul Rohatgi & Amazon’s counsel Gopal Subramanian agreed “no one is going to win this business war”. The CJI Ramana suggested that why don’t instead of these battles everywhere, there be a dialogue to end this and also it was proposed that arbitrator can be urged to decide jurisdiction issue as early as possible?. Senior lawyer, and former Attorney General of India (AG) Mukul Rohatgi, for Future, said that we are facing injunction in terms of our scheme. “We have a debt of Rs 27,000 crores. One company wants to take it up. Now there is a proposal of talks but what about the injunction?,” Rohatgi said. CJI said, we allowed the Delhi High Court and NCLAT to proceed. we can ask them to not pass order for the next 10 days. The Supreme Court was hearing the petition filed by Amazon against the Delhi High Court’s order which stayed the ongoing arbitration proceedings before an arbitral tribunal over Future Retail’s deal with Reliance.
