Court Seeks Explanation from Personnel Secretary and Medical Director Over Non-Compliance

Udaipur / Jaipur, January 30 The Rajasthan High Court has directed the immediate posting of a Joint Director in the Medical Department who is set to retire on January 31. The court has also issued a notice to the Principal Personnel Secretary and Medical Director, seeking an explanation for their failure to comply with the Civil Services Appellate Tribunal’s order regarding the official’s reinstatement.

The single bench of Justice Anoop Kumar Dhand issued these directives while conducting a preliminary hearing on a petition filed by Zulfikar Ahmed Qazi.

Background: Suspension Revoked, Yet No Posting Order Issued

Petitioner’s counsel, Advocate Vijay Pathak, informed the court that:

  • Qazi was serving as the Joint Director in the Medical Department, Udaipur.
  • On August 22, the department suspended him due to an ACB-related case and instructed him to report at the Jaipur headquarters.
  • The Civil Services Appellate Tribunal had revoked the suspension order last month.
  • Despite the tribunal’s ruling, the department failed to reinstate him, causing unnecessary delay.

With his retirement due on January 31, the petitioner argued that the non-posting would negatively impact his pension and other post-retirement benefits.

High Court’s Ruling

After reviewing the case, the Rajasthan High Court directed the immediate posting of the petitioner and sought a response from concerned officials regarding their non-compliance with the tribunal’s decision.

This ruling ensures that the petitioner’s retirement benefits remain unaffected, setting a precedent for adherence to judicial and tribunal orders in service matters.
